Probate is a judicial proceeding in which a court admits a valid will (referred to as a testate proceeding) or determines that the decedent did not have a valid will (referred to as an intestate proceeding). In either type of proceeding, the court appoints a personal representative who has the authority to collect a decedent’s assets, discharge a decedent’s debts, prepare and file appropriate tax returns, and ultimately distribute the decedent’s assets pursuant to the decedent’s dispositive documents or, in the absence of such documents, as set forth under Colorado law. The administration of a decedent’s estate may also include the administration of trusts created by the decedent and the preparation and filing of estate and fiduciary income tax returns.
